PARKING TICKET NEAR A DUMPSTER
MY DAUGHTER IS A COLLEGE STUDENT IN WACO, TX. SHE WENT TO COLLEGE STATION, TX TO VISIT A FRIEND. SHE ARRIVED AROUND 8P.M. AND PARKED IN FRONT OF THE APARTMENT COMPLEX WHERE THERE WAS A DUMPSTER APPROX. 10 FEET WHERE SHE PARKED. THE NEXT MORNING APPROX. 11A.M. SHE WENT OUT TO HER CAR TO LEAVE. WHEN SHE GOT TO HER CAR IT WAS JUST ABOUT TO BE TOWED. THE DRIVER SAID SHE WOULD HAVE TO PAY HIM $85.00 NOT TO TOW HER VEHICLE, IT WAS NOT HOOKED UP YET... HE TOLD HER SHE WAS IN A NO PARKING AREA... UNTIL THE DRIVER OF THE TOW TRUCK SHOWED HER WHERE THE SIGN WAS SHE DID NOT SEE IT, IT WAS BLOCKED BY A TREE AND BOXES THAT WERE STACKED IN FRONT OF THE DUMPSTER AND THE SIGN. SHE PAID THE DRIVER THE $85 FOR HIM NOT TO TOW HER CAR. SHE THEN NOTICED A PARKING TICKET ON HER WINDSHIELD WHICH SAID SHE WAS WITHIN 12 FEET OF THE DUMPSTER? IF A SIGN IS NOT VISIBLE BECAUSE OF AN OBSTRUCTION CAN SHE BE TICKETED OR CAN THE TOW TRUCK DRIVER LEGALLY CHARGE HER FOR A TOW THAT WAS NOT DONE? THEY TOOK PICTURES OF THE TREE BLOCKING THE SIGN AND THE BOXES. SHOULD SHE TRY AND FIGHT THIS IN COURT... I THINK THEY GO AFTER THESE KIDS BECAUSE THEY THINK THEY HAVE PARENTS WHO HAVE MONEY! MY DAUGHTER IS ON FULL FINANCIAL AID AND SCHOLARSHIP MONIES TO ATTEND COLLEGE. SINCE THE CAR IS REGISTERED TO US THEY SENT US A LETTER STATING WE WOULD BE SUED IF THE TOW CHARGES WERE NOT PAID (SHE HAD STOPPED PAYMENT ON THE CHECK AFTER SHE CALLED ME AND EXPLAINED THE SITUATION)... I SUPPOSE THE NEXT THING THE CITY WILL SEND US NOTIFICATION OF AN UNPAID PARKING VIOLATION. I DO NOT KNOW IF ANYONE, POLICE OR TOWING COMPANY MEASURED THE EXACT SPACE BETWEEN HER CAR AND THE DUMPSTER? SHE'S WORKED VERY HARD TO GET GOOD GRADES, NOT DRINK, NO DRUGS AND SHE FEELS LIKE SHE HAS TO KEEP PAYING WHEN OTHERS KEEP GETTING AWAY WITH MURDER - LITERALLY. SHE CAN'T AFFORD THESE EXPENSES WHICH I FEEL ARE NONSENSE. ANY ADVICE WOULD BE APPRECIATED. THANK YOU.

- Don't ignore the ticket. I know it's a major waste of time, but I'd recommend fighting it. It seems cruel and that you're being taken advantage of, but consider it a lesson learned. Explain to the traffic court exactly what you said here, and you'll probably have it dismissed. Was the ticket a municipal or county ticket? or was it issued by campus police. If it's governmental and you ignore it, you could end up having your license denied. If it's issued by campus police and you ignore it, it will be turned over to a collection agency and will appear on your credit report. If you can't make it to traffic court, admit defeat and pay the ticket.#1; Mon, 24 Jan 2000 13:31:00 GMT
